2. ACCEPTANCE OF TERMS

By accessing and placing an order with Tierra Kaffe, you confirm that you are in agreement with and bound by the terms of service contained in these Terms. These terms apply to the entire website and any email or other type of communication between you and Tierra Kaffe.

3. PRODUCTS AND PRICING

All prices are listed in Danish Kroner (DKK) and include applicable VAT unless otherwise stated. We reserve the right to update product information and pricing at any time. Product availability is subject to change.

4. ORDERS AND PAYMENT

When you place an order, you will receive an email confirmation. This does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason. Payment is processed securely through our payment provider.

5. RIGHT OF WITHDRAWAL (FORTRYDELSESRET)

In accordance with Danish consumer protection law and EU Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to food products, including coffee, due to their perishable nature and hygiene considerations.

However, your right to complain remains fully valid. If you receive a defective product, products that do not match the description, or products damaged during shipping, you have the right to file a complaint and receive a remedy (repair, replacement, price reduction, or refund as appropriate).

We will respond to your complaint promptly and work to resolve the issue in accordance with Danish consumer protection laws.

6. REFUNDS

Since food products (including coffee) are exempt from the right of withdrawal, refunds are not available for change of mind or personal preference.

However, if you receive a defective product, a product that does not match its description, or a product damaged during shipping, you are entitled to a remedy under Danish consumer protection law. Depending on the nature of the issue, this may include:

  • Replacement of the defective product
  • Repair (where applicable)
  • Price reduction
  • Full refund

To request a remedy for a defective or non-conforming product, please contact us at thor-andersen@tierrakaffe.dk or +45 20811537 as soon as possible after receiving your order. We will assess your complaint and provide an appropriate solution in accordance with Danish consumer protection laws.

Please note that we may request photos or other documentation to assess the complaint.

If you exercise your right of withdrawal, we will reimburse all payments received from you, including delivery costs (except for supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day we receive the returned goods.

7. DELIVERY

Delivery times and shipping costs are specified during checkout. We ship to addresses within Denmark and the EU. Risk of loss and title for items purchased pass to you upon delivery to the carrier.

8. JURISDICTION

These Terms of Service and any disputes arising from them shall be governed by Danish law. The place of jurisdiction is Aalborg, Denmark.

9. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are willing to participate in dispute resolution proceedings before a consumer arbitration board.
